Efcc Indicted In Cover-up Of Diamond Bank Scams

EFCC indicted in cover-up of Diamond Bank scams

Diamond Bank Plc has been found by our investigation to be habitually flouting the laws of the land by engaging in bribe giving and lying on oath about its operations. The EFCC in the course of some other developments found out this fact, aided and abetted the bank in breaking the laws of the land by keeping mute on the contraventions rather than prosecuting the guilty officials.

 

                This Reporter’s investigations showed clearly how the EFCC may have also been compromised in adding and abetting the commission of a crime by the bank. Investigations revealed a long string of gory details of unethical conducts by the bank. This Reporter shall unveil all these details gradually. However here’s a sample.

 

                One of the bank’s biggest clients, a lady (names withheld) whose business activities gives the bank N60m profit monthly and whose total turnover as at October 2008 is N51billion, is in court over a N1.3billion cheque discount facility. The facility, ordinarily, was a clear contradiction of the N250m immediate credit on cheques from other banks allowed to this client by the bank. On a particular occasion, one of her deals did not yield the usual profit. It backfired. It involved Guaranty Bank Plc. Guaranty Bank Plc warned Diamond Bank Plc but the latter went on with the deal. Diamond Bank in order to recover her money took the client to court! We gathered that eight low and middle management staffers of the bank were sacrificed as a result.

 

                Diamond Bank Plc reported the staffers in question through a petition to the EFCC accusing them of having conspired with the client to steal N70m and were in the process of fleeing the country. This led to the arrest in October 2008 of six of the eight staffers. The other two were on leave. Those arrested were detained for seven days in a stretch.

 

Our investigations also showed that the bank a month earlier, in September 2008, gave out a brand new Honda Accord worth N5m to the client on her birthday. It was realised that in the process of investigations, the EFCC found Diamond Bank Plc to have flouted the laws of the land in the required weekly reportage of such transactions to the Nigerian Financial Intelligence Unit (NFIU) of the EFCC. Now, the questions are: why did the EFCC not prosecute Diamond Bank Plc for not reporting that particular transaction to the NFIU? Would the bank in what is becoming its tradition not have ‘bought their way’ again in this issue?

 

Diamond Bank Plc is accused in an affidavit in a court of law (see: Diamond Bank Plc Vs GTB PLC, Mofadeb Nigeria Limited, Nukep Nigeria Limited and Dupsob Nigeria Limited) to “in the course of normal businesses habitually engage in unethical practice contrary to acceptable norms of banking practices” by offering inducement to state government and senior key officials of parastatals to place substantial funds belonging to their employers in return for a percentage of interest earned. To cover their tracks, they put such expenses in the bank books as purchases of gifts, consultancy services and public relations.

 

POSERS:

 

                It is a fact that so many senior officers of the bank has over the years when the going was good been benefitting from the client. They give approvals, including a car gift on the occasion of the client’s birthday in September and in October they are in court with the same client. Why did the management staffers cover themselves and picked eight ‘younger’ staffers lower on the rung of authority to be sacrificed on the anvil of dismissal? They become pawns in their chessboard. They took the same client to court to recover the same ‘stolen’ fund for which those eight were dismissed! They were dismissed for negligence! Ask, negligence on whose part? Where lies morality and legality?

 

                If the client has an approval limit of N250m immediate credit on other bank cheques, how did Diamond Bank Plc gave out N1.278billion immediate cash as against the approval limit of N250m? Who approved the money? Did no senior officer of the bank controlled proceedings on that account? Was the regular analysis conducted on that account not done?

 

Caught in the web, Diamond Bank Plc in another court averred that the fraud she committed in approving N1.278b as against N250m official ceiling, admitted on oath: “is in accordance with normal and prudent banking practice.” Uhm! Yet, this transaction is supposed to have been reported by the bank to the EFCC’s NFIU. This the bank did not do. EFCC operatives found out this but like janus, turned the other eye

 

FAIR-HEARING:

 

In order to get the official bank responses, calls were pulled to the bank’s Corporate Communications via the switch board telephone numbers 01-2701500 and 01-7741215. E-mails were sent to them to have their own side of the stories, they won’t respond to either. Rather, we had whiff from within our contacts in the bank that they have started making offers to ensure that “the stupid journalists pursuing the stories are settled out of reporting the case”.

It seems that the whole story is not complete. I guess more work needs to be done. The story is just beyond the fact these staffers were sacked. We heard that other peoples money (OPM) involved here is in excess of =N=7bn. In fact, it is a shame that EFCC is chasing government officials over few millions whereas the subject staffers were invloved in a scam that took and buried over =N=7bn. They should all be cooling off in a long jail sentence along with the semi-illiterate lady they call Madame Dupsop.

if i am right, this is the incident that took the banking circles in Ibadan by storm about a year and a half ago. As far as i am concerned it was simply a case of negligence of the entire management and staff of diamond bank. My bank would have been affected but our management was proactive at least for once. It is always very rare though for top management to take responsibility when things go awry. From what we gather, no staff was found guilty of any criminality by EFCC, even though the bank tried unsuccessfully to potray the staff who i understand were finally dismissed as criminals. The greed for profitability by banks was responsible for all this wahala. Chikena!

@tope- i understand your point of view. i think ukpaka should shed more light on this issue. but i also fault your conclusive argument. what if the 8 staffers are really innocent. u sound as if it is not possible. this things have been happening in this country and i think it is time we all put a stop to it.

1 tend to align with Topes views about an organisation weilding the big stick when infractions are committed. However, what we might need to know is if these staffers were criminal or there are other issues involved especially as ukpaka claims that a brand new car was given the customer a month before the incident. i am not aware that banks give gifts of that amount o. getting my bank to give me a diary is usually a big problem talk less of a car. I think i ll need more info before arriving at a conclusion. there is no smoke without a fire

I dont take whatever news item i pick from blogsites and onlines news portal as Ukpaka too serious. Internet and new media have made it possible for anybody to just post anything on website in the name of citizen journalism. This story has no basis and the facts presented do not add up. It may not be as simple as Ukpaka want us to believe. I dont think Diamond Bank will just sack 8 staffers without any just reasons. Come to think of it there is no law in Nigeria that stops any employer from applying the big stick against employee when an infraction has been committed by such employees.

I seem not to know what this hullabaloo is all about. It appears some of the commentators here are writing out of ignorance. Ukpaka report seems to me to be doing a hatchet man's job by presenting the case of the so-called staff as if it is a gospel truth. People in glass house they say dont throw stones. If it is true the said loan was packaged from the top it will be difficult for a bank to sack people below who are merely carrying out orders. The truth is that the affected staff are raising sentiment and want to make us believe they are being used as fall guys. They are caught in their criminal acts and sanctioned by their employer. There is no law that says in Nigeria that employers cant apply whatever sanction necessary on employees whenever there is infraction. If the guys committed infraction the bank is in order to apply the big stick. Period.

The whole of this bank began with the appointment of Sanusi as Chairman. Fracas in private between sanusi and onwuka...going to when Sanusi was failing as Firstbank chairman, now found itself into everyday business. If this is the same Ademola, well am very angry is low life talk from you. What is going with Nigerians anyway? Look at how much warning I personally put up about indefensive Union Bank profit and the CBN Governor did not make any civil effort to helm the tide of failure, leaving the Bank vulnerable to Canadian takeover. A whole Union bank converted by foreign oufit and SANUSI just stand there like he knows what he is doing. What SANUSI and ridiculous people like both you are interested in chicken and egg story about car, when Banks are loosing Billions in Nigeria. For at least five years, Diamond Bank as an investment bank, topped Nigerian gainers chart. Is it realy a con-incidence that the complain of SANUSI that Igbos were doing behind the curtain business could all of a sudden gain weight with his appointment. Besides, you don't work for these banks, so how could be talking about personnel management.

I have heard so much about this particular bank and the way they treat their staffers. I hope the staffers involved would take them to court on this, so they dont get away with this as well. Its gone out of hand and these organisations just end young promising careers, without any real reason. Negligence is written all over the story and the management of this bank should bury their heads in shame instead of making junior staff pay for it. IT IS NOT OK "as long as original monies borrowed is returned", these deals always goes sour eventually,why not just do things the right way from the start???

The report did say that efforts were made to contact the bank, what about the EFCC leadership, was any effort made to ask them why they allegedly aided the above accusation(s)? How come in the contact within the bank did get anything or than the move to try and bribe the journalist? Haba, we are not all stupid pls

Uhm! May God help the seniors who steal, approve the funds that the client got and bought her a car in September and in October sacked eight middle level staffers. Who is negligent? Those who approved the money the client can't pay or those who acted upon the instruction of the bosses? Methink, these staffers should take the stupid Diamond Bank Plc to court for damages.
This should not be the end. Diamond Bank Plc must be tried in a law court. Farida Waziri wake up! This is a good case for institutional corruption that must be brought to book!

my ayodeji should go and investigate other banks that give credit facilities to highly placed individuals without any collateral only for them to default. if Diamond bank funds drugs, marijuana or even prostituion as long as the original sum loaned out is put back(depositors money) it is ok. Our banking system is not structured to give long term loans for projects hence banks have to hustle to turn a profit. AS LONG AS ORIGINAL MONIES BORROWED IS RETURNED. ITS ALL GOOD
